What is the benefits policy for internship contracts?

To understand the benefit policies for interns, it is first necessary to be clearer about what the law says about an internship contract. The so-called Internship Law (Law 11.788) does not see this work as an employment relationship, but rather as an extension of the learning received in college.


Regardless of whether the internship program is mandatory or not in a university course, the rights and duties of the professional and the company are the same. That said, the only benefit that must, obligatorily, be offered to the student is insurance against personal accidents, always in the name of the one being hired. Not even the stipend (the legal name of the intern's salary) is mandatory.


The student is also entitled to paid holiday after one year of work. Benefits intrinsic to CLT, such as FGTS, 13th salary and prior notice are not guaranteed. 


In addition, internship programmes must be formalised in a contract signed by both the company in question and the educational institution. 


How do trainee benefits work in practice?

Now that you have a better understanding of the internship contract, it is certainly easier to understand how intern benefits work. Although they are not mandatory, many organisations offer them as a way to increase employee satisfaction.


From the moment the organisation proposes to offer a certain benefit to the trainee, the information must be contained in the contract and the benefit must be offered periodically. It must be made clear in the terms that the meal voucher is being offered by the company of its own free will.


If that is the organisation's decision, the student can freely take advantage of what has been offered, in the same way as the rest of the employees.
